JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner, learned counsel appearing on behalf of O.P. No.2 and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Pipra Kothi P.S. Case no. 187 of 2016, registered under Sections 498(A), 504 and 506 of the Indian Penal Code and Section 3/4 of D.P. Act.
Learned counsel for the petitioner and O.P.No.2 submits that dispute between the parties has been settled and accordingly, both have decided to live separately. The petitioner has handed over Cheque of Rs. 90,000/- to O.P. No.2 by way of one time settlement. The O.P. No.2 is present in Court physically and she accepted about settlement of the dispute and she has received cheque
Patna High Court Cr.Misc. No.14368 of 2017 (5) dt.09-08-2017 2/2 of Rs. 90,000/- from the petitioner.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Sadar, Motihari East Champaran in connection with Pipra Kothi P.S. Case No. 187 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
