JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 307 and other ancillary sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, while the informant was sitting in his Jagdamba Tent Decoration House, petitioner along with other co-accused persons, variously armed, arrived at his shop and made indiscriminate firing causing injuries on his waist backbone, left arm near pelvis and left rib of the informant. Informant has further alleged in the FIR that earlier petitioner and his associates had demanded rangdari of Rs.2 lacs and on refusal, the accused persons committed the offence in which petitioner was caught by the villagers and handed over to the police.

Learned counsel for the petitioner denies the allegations levelled against the petitioner and submits that the informant, in the FIR, claims to have sustained five fire arms injuries but the doctor has found only one fire arms injury on the person of

Patna High Court CR. MISC. No.59628 of 2021(2) dt.08-02-2022 2/2 the informant. Petitioner is in custody since 31.3.2021. other similarly situated co-accused have already been allowed bail by different co-ordinate benches of this Court vide orders passed in Cr.Misc.No.

23747/2020, 85919/2019 and 68705/2019.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate I, Barh in Barh Police Station Case No. 318 of 2019.
