JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 05-02-2018 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner is seeking regular bail in Banmankhi P.S. Case No. 167/2017 registered for the offences under Sections 365 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that in the present case save and except a mere suspicion nothing exists to implicate this petitioner. Learned counsel submits that, according to the F.I.R., the uncle of this informant had gone for fishing to the pond and altogether four persons were doing this fishing work together. When the uncle of this informant did not return he went to find him out at the said place where he asked this petitioner and two other persons about the whereabouts of his uncle but they did not inform and rather threatened.

No.5362 of 2018 (2) dt.05-02-2018 2/2 Learned counsel submits that no material has come so far to implicate this petitioner and the co-accused Fuleshwar Risi has been granted the privilege of regular bail by a co-ordinate bench of this Court in Cr. Misc. No. 61566/2017 vide Annexure-2. The petitioner has got no criminal antecedent. Learned counsel for the State is present.

Considering the facts and circumstances, let the petitioner, named above, be enlarged on bail on his furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Purnea in connection with Banmankhi P.S. Case No. 167/2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
