JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Shahpur P.S. Case No. 28 of 2019, disclosing offences under Sections 147, 341, 323, 379, 506, 307, 385 and 504 of IPC.

Allegation against the petitioner no.1 is of assault by rod to the informant and against petitioner no.2 of tiding the towel around his neck in order to kill him. Further allegation is of snatching of Rs.20,000/- from his pocket by one Dilip Kumar.

Submission of the learned counsel for the petitioners is that as a matter of fact the informant has taken Rs.1,00,000/- from the accused Manoj Rai and Rs.41,000/- is still due and he has been demanding the same from the informant, for which, a

No.47397 of 2019(2) dt.30-07-2019 2/2 Panchayati was also organized, in which the informant and his family members abused the badly assaulted the accused persons, for which a case has been lodged being Shahpur P.S. Case No. 30 of 2019 against the informant and his family members. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, District Patna, in connection with Shahpur P.S. Case No. 28 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
