JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-09-2016 Counsel for the opposite party no.2/informant is present along with the informant however none appearing on behalf of the petitioner.

It appears that vide order dated 27.06.2016 the mater was adjourned on the prayer of counsel for the petitioner for 18th of July, 2016 at 4.15 PM in Chambers but when the matter was taken up on 20.07.2016, none was appearing on behalf of the petitioner when the matter was adjourned for today but today also none is appearing on behalf of the petitioner. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 323, 341, 498A and 504 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

The marriage between the petitioner and the informant/opposite party no.2 is admitted. Counsel for the opposite party no.2 submits that the informant is ready to resume the conjugal life.

Since none is appearing on behalf of the petitioner, the application is disposed of with liberty to the learned court below to consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Dalsinghsarai P.S. Case No. 269 of 2015 pending in the court of learned ACJM, Dalsingsarai.
