JUSTICE RAKESH KUMAR ORAL ORDER 17-12-2015 Heard Sri Basant Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 24.08.2015 in connection with Chandauti P.S. Case no.99/2014 registered for the offence under Section 302 and other allied Sections of the Indian Penal Code and Section 27 of the Arms Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that in the F.I.R. there is specific accusation against accused Umair Miyan, who gave first shot of fire on the chest of father of the petitioner, accused Kaiser Miyan,who alsofired on the father of the informant and subsequently Nasim Miyan and Ghulam Rasool had also fired in the occurrence. He submits that in the F.I.R.,

Patna High Court Cr.Misc. No.55305 of 2015 (2) dt.17-12-2015 2/2 there is specific accusation against the other accused persons and five persons were named as accused in the F.I.R. besides 2-3 unknown persons. He further submits that the petitioner's name has come during investigation.

Keeping in view the fact that there is specific accusation against other accused persons, there is no reason to detain the petitioner behind bar. Let the petitioner, namely, Ranjeet Kumar be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Chandauti P.S. Case no.99/2014. (Rakesh Kumar, J) NKS/- U
