2. This criminal appeal has been filed against the order dated 27.11.2020 passed by learned Exclusive Special Judge SC/ST (POA) Act, Gaya in ABP No. 201 of 2020 arising out of Bodhgaya P.S. Case No. 76 of 2016, registered under Sections 447, 385, 427, 504/34 of the Indian Penal Code and Sections 3(1-v)(1-x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, whereby the prayer for anticipatory bail of appellant has been rejected.
3. As per prosecution case, all the F.I.R. named
Patna High Court CR. APP (SJ) No.686 of 2021(4) dt.09-04-2026 2/2 accused persons, including this appellant, damaged the boundary wall of informant and upon objection, they abused informant by caste name and assaulted her.
4. Learned counsel for the respondent no. 2 submits that on 18.09.2020 regular bail application of the appellant was dismissed by learned Exclusive Special Court SC/ST, Gaya and after hearing the dismissal order, this appellant fled away from the court. Non-bailable warrant has already been issued against the appellant.
5. Considering the nature of accusation and conduct of the appellant, I do not find any ground to interfere with the order of the learned court below and as such, the appeal, which has been filed for grant of anticipatory bail, is hereby rejected. (Prabhat Kumar Singh, J) Navya/- U T
