JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2015 Both petitions arise out of Economic Offence P.S. Case No. 13 of 2013 registered under Sections-406, 409, 419, 420, 465, 467, 468, 471, 472, 473 and 120(B) of the Indian Penal Code in which, petitioners apprehend their arrest and accordingly, both the above-said petitions are being heard and disposed off by this common order.

Heard learned counsels for the petitioners and learned Additional Public Prosecutor for the State.

Patna High Court Cr.Misc. No.32004 of 2014 (4) dt.31-03-2015 2/2 The name of both these petitioners surfaced in the statement of named accused, Sunny Priyadarshi, who was caught along with forged documents and on the date of his arrest, he disclosed the name of these petitioners.

Regard being had to the facts and circumstances of the case as well as submission of the parties, I do not think it proper to extend the privilege of anticipatory bail to the petitioner and accordingly, prayer for anticipatory bail of the petitioner in connection with Economic Offence P.S. Case No. 13 of 2013 pending stands rejected.

However, if, petitioners surrender in the court below and seek regular bail, this order shall not cause any prejudice to the learned court below at the time of consideration of regular bail application of the petitioners.
