Petitioner, already in custody since 16.8.2017, seeks bail in Bihiya PS Case No. 202 of 2017, registered under Section 304B/34 of the IPC.
The allegation in brief is that marriage of the deceased was solemnised six years back with the petitioner, it is alleged that she was tortured in connection with realization of further demand of dowry and ultimately killed.
Submission is that never earlier any complaint regarding torture against the petitioner was lodged and the fact remains that she fell down from stair-case of the house, sustained injury in the form of bruise on the back of the head and taken to hospital for treatment but she died.
Having considered the said facts and circumstances, the petitioner Baiju Nath Gupta is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bhojpur at Ara in connection with Bihiya PS Case No. 202 of 2017.
