The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

On information that the stolen articles have been transported, raid was laid, when 42 pieces of battery and other articles were recovered. Two persons were apprehended and others escaped from the scene. The apprehended accused suggested the name of the petitioner as the owner of the pick-up van from which recovery was made and at whose behest the stolen batteries from the mobile towers were being transported.

Patna High Court Cr.Misc. No.4752 of 2016 (2) dt.04-02-2016 2/2 It is submitted by learned counsel for the petitioner that the petitioner's public carrier was hired by the accused persons and petitioner has no concern with the alleged stolen battery.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Fatuha P.S. Case No. 412 of 2015 pending in the court of learned Additional Chief Judicial Magistrate, Patna City.

With the aforesaid observation, this application is disposed of.
