JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-02-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 24.09.2014 passed in Cr. Misc. No. 16785 of 2013 on the ground that the trial has not been concluded within the period of six months as per order of this Court and out of eight prosecution witnesses, six prosecution witnesses have already been examined and no one has identified the petitioner, to which the learned A.P.P. opposes by submitting that the robbed amount of the Bank was recovered from possession of the petitioner.

Finding no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in

Patna High Court Cr.Misc. No.55152 of 2015 (5) dt.25-02-2016 2/2 connection with Sessions Trial No. 121 of 2014/ 163 of 2013 arising out of Rampur P.S. Case No. 205 of 2011 pending in the court of the Additional Sessions Judge, 8th, Gaya. However, the learned trial Judge is directed to expedite the trial and to conclude the same preferably within a period of three months from the date of receipt/production of a copy of this order by keeping the same on the day to day basis and also by taking all positive steps to secure the attendance of the witnesses.

Let a copy of this order be also sent to the Senior Superintendent of Police, Gaya to ensure that the remaining two prosecution witnesses will be produced in the court by taking the personal initiative keeping in view that the case relates to the Bank dacoity.
