Petitioner seeks bail in a case registered for the offences punishable under Sections 409 of the Indian Penal Code.

Petitioner is Incharge Principal of the School. Allegation is that the petitioner defalcated Rs.3,00,000.00 and odd, which was meant for construction of the building.

Submission of the learned counsel for the petitioner is that the building of the school has already completed. Only plaster work was to be done. However, due to shortage of sand in the State of Bihar after

Patna High Court Cr.Misc. No.6975 of 2018 (2) dt.06-02-2018 implementation of the new Policy by the Government, the same could not be completed. The petitioner undertakes to complete the plaster work within six months of his release. Considering the undertaking of the petitioner, let the petitioner, above named, be released on provisional bail for six months and the same shall be confirmed by the learned court below only on production of certificate by the petitioner from the competent authority that work has already been completed, on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Thakraha Police Station Case No.210 of 2017.
