The petitioner apprehends his arrest in a case registered under different sections of the Indian Penal Code and Section 47(A) of the Excise Act.
The informant raided two places and recovered foreign liquor and beer. The first place of raid is the house of Bhagwan Kuswaha and the second place of raid is the house of Mostt. Kusmi Devi.
It is submitted that the petitioner being the licensee of a wine shop used to sell the wine in different places. From a perusal of the record it appears that the houses of two persons, namely, Kusmi Devi and Bhagwan Kuswaha, were raided and from there different brands of foreign
Patna High Court Cr.Misc. No.34258 of 2014 (2) dt.12-02-2015 2/2 liquor etc. were recovered. Nothing is brought on the record to show that the petitioner was selling foreign liquor. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar, in connection with Murar P.S. Case No.05 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
