JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,307,504,379 and 506/34 of the Indian Penal Code.
It is alleged that in the background of a dispute with regard to vacating the land, the petitioner along with co accused persons came with lathi and danda, abused and assaulted the informant and the petitioner took out cash of rupees five thousand from the pocket of the informant.
It is submitted by the learned counsel for the petitioner that petitioner is the nephew of the informant and in the background of bonafide land dispute the accusation has been levelled. There is counter version of the occurrence and the injury
Patna High Court Cr.Misc. No.4734 of 2016 (2) dt.04-02-2016 2/2 of the informant has been found to be simple. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Madhepura in connection with Shankarpur P.S. Case No.90 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
