The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 308, 379 and 504/34 of the IPC.

The prosecution case, as per the written report of Devnarayan Yadav, dated 18.04.2019 submitted to the Station House Officer, Nardiganj Police Station, is to the effect that the informant was coming from his agricultural field, but on the way, all the accused persons including the petitioners assaulted the informant and snatched a gold chain from his neck. It is submitted by learned counsel for the petitioners that

Patna High Court CR. MISC. No.47894 of 2019(2) dt.01-08-2019 2/2 the accusation against the petitioners is omnibus and general. There is no injury report of the informant on record to corroborate the accusation. A statement has been made in paragraph no.3 of the petition that petitioner no.1 is not having any criminal antecedent, whereas petitioner no.2 is also made accused in one other case, in which he is on bail. Learned APP submits that the petitioners are named in the FIR with specific accusation.

Considering the accusation against the petitioners, being omnibus and general and the accusation not being supported by any medical opinion, let the above named petitioners be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Nawada in connection with Nardiganj P.S. Case No. 98 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
