The petitioner apprehends his arrest in a case registered under Section 498A of the Indian Penal Code and Sections 3 / 4 of the Dowry Prohibition Act.
The wife made allegations that her husband subjected her to physical and mental torture and drove her out from the house.
The complainant was married with the petitioner in the year 2002. She alleged that the offence continued since 2002 to 2013.
On perusal of the complaint petition, it appears that the complainant has brought this complaint case against her
Patna High Court Cr.Misc. No.34747 of 2014 (2) dt.18-02-2015 2/2 husband alleging that he has continuously subjected her to torture since 2002 to 2013, but she did not make any complaint during that period about the ill-treatment given by the petitioner. On the face of it, it appears that the wife has filed this complaint case on account of some family dispute.
Considering the facts aforesaid, the above named petitioner, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in Complaint Case No. 1997 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
