JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 21-09-2016 Heard learned counsels for the petitioner as well as opposite party no.2 representing North Bihar Power Distribution Company Limited along with learned Additional Public Prosecutor.

During course of submission, learned respective counsels have agreed that it is a fit case wherein exercise of Section 152 of the Indian Electricity Act would be permissible. Learned counsel for the opposite party no.2 has further submitted that he is going to instruct the officials to accept the amount along with compounding fee in case presented by the petitioner and further, would enter into a

Patna High Court Cr.Misc. No.23415 of 2016 (02) dt.21-09-2016 compromise as soon as the amount is deposited. Learned counsel for the petitioner given his nod.

Accordingly, instant petition is disposed of under the aforesaid eventualities having perceived and further, the learned lower Court is directed to dispose of the case on the same day on which compromise petition is being filed.
