The petitioner seeks bail in connection with Rajapakar P.S. Case No. 155 of 2017 registered under Sections 328, 302 IPC and Section 34(B) (1)/37(D) (1) of Bihar Excise Amendment Act -2016.

Two persons have lost their lives while two lost their eye sight after consuming spurious liquor at the house of Adalat Paswan, brother of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner has no concern with his brother, Adalat Paswan or with his business. Petitioner is not named in the F.I.R. None of the

Patna High Court Cr.Misc. No.6870 of 2018 (2) dt.16-02-2018 2/2 eye witness has named the petitioner in the occurrence. Petitioner has been implicated in this case only because he happens to be brother of Adalat Paswan. He has no concern with the place of occurrence. He has no criminal antecedent. He has been languishing in custody since 09.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Hajipur, Vaishali in connection with Rajapakar P.S. Case No. 155 of 2017.
