JUSTICE SUDHIR SINGH ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 188, 353 and 290 of the Indian Penal Code and Sections 3 / 4 of the Loud Speaker Act. . The prosecution case is that petitioner along with others had proceeded towards Muslim Road for Murti Bisarjan, which was objected by the informant and others. No untoward incident had taken place and the procession proceeded peacefully. Petitioner has been involved in the case because he is a licensee. It is submitted on behalf of the petitioner that he has got no criminal antecedent. He has been made accused due to mistake of fact. He was not present at the time of Bisarjan of Laxmi Puja. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Nawada Town
