JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bikramganj P.S. Case no. 134 of 2017, registered under Section 366(A) of the Indian Penal Code.

The accusation is that on 13.05.2017 the daughter of the informant went to the market for purchase of grocery, but she did not return. Thereafter, informant started searching his daughter then Krishna Kumar, nephew of the informant, disclosed him that his daughter was seen boarding on the motorcycle of his villager Sunil Kumar, son of Binod Mahto (Petitioner) and Indal Kumar and Abhishek Kumar were also seen behind them. When informant reached at the house of Sunil Kumar then his parents started abusing him. Further allegation of informant is that his daughter also carried

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the allegation of kidnapping of daughter of the informant is against Sunil Kumar, who is son of the petitioner and petitioner has falsely been implicated in this case due to dirty village politics. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Bikramganj Rohtas in connection with Bikramganj P.S. Case No.134 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
