The petitioners apprehend their arrest in connection with Madhuban P.S. Case No. 92 of 2019, registered under Sections 363 and 366A/34 of the Indian Penal Code. The accusation is of kidnapping of Khushi Kumari, daughter of the informant by Chandra Bhushan Kumar with the help of Mishri Lal, Mishri Lal Sah and these petitioners. Learned counsel for the petitioners submits that it would appear from the F.I.R. that at the time of kidnapping of daughter of informant, petitioners were present at their sweet

No.46924 of 2019(2) dt.31-07-2019 2/2 shop, in fact, daughter of informant moved from there according to her own sweet will but due to dirty village politics petitioners have also been implicated in the present case with false allegation. Further submission is that, in course of investigation, police recorded the statement of Md. Akthar, who has stated about kidnapping of daughter of informant by Chandra Bhushan Kumar, son of Mishri Lal Sah and petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 4th Additional Chief Judicial Magistrate, Motihari, East Champaran, in connection with Madhuban P.S. Case No. 92 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
