The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

Accusation against the petitioner is that he being a fertilizer dealer charged accelerated price of the fertilizer. It is submitted by the learned counsel for the petitioner that the First Information Report was registered on the complain of a farmer Rinku Kumar, who suggested that he purchased Urea at the rate of 350 and D.A.P. at the rate of 1240 from Vishwkarma Khad Bhandar, whereas the petitioner is proprietor of M/s Ratan traders Dawath, which gets reflected in the First Information Report itself.

Patna High Court Cr.Misc. No.4768 of 2016 (2) dt.04-02-2016 Considering the above inconsistency and coupled with the statement made in para-3 of the petition that petitioner has no criminal antecedent, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Dawath P.S.
