JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-03-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sakra P.S. Case No. 15 of 2018 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act, 2016.

The accusation is of recovery of 1420.500 litres Indian made foreign liquor to the truck bearing Registration No.63B5730, from which, three persons started to flee away, but on chased, they were arrested and disclosed their names as Manpal (Truck Driver), petitioner Ajay (Khalasi) and Rabindra Kumar. On query, they disclosed that the aforesaid materials were loaded on the truck by Navin Dahiya at Panipat.

Patna High Court Cr.Misc. No.17414 of 2018 (2) dt.28-03-2018 Learned counsel for the petitioner submits that petitioner is simply Khalasi of the truck and he has no concerned with the seized liquor. It is further submitted that petitioner has no criminal antecedent and is in custody since 09.01.2018. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur, in connection with Sakra P.S. Case No. 15 of 2018.
