The petitioner seeks bail in anticipation of his arrest in connection with Sikandra P.S. Case No. 56 of 2020 dated 13.03.2020 instituted for the offences under Sections 147, 148, 149, 341, 323, 307 and 506 of the Indian Penal Code.
Though several persons have been made accused in this case but the accusation against the petitioner is of having given a sword blow on the head of the informant. However, the informant has received only simple injuries.
There is a counter version of the occurrence also.
Patna High Court CR. MISC. No.5882 of 2021(2) dt.02-11-2021 2/2 Learned counsel for the petitioner has submitted that because of a petty dispute between the two set of agnates, an occurrence took place in which both sides have assaulted each other. There does not appear to be any intention on the part of any of the accused persons including the petitioner to cause any grievous or life threatening injury.
For the reasons aforestated and taking into account the clean antecedents of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jamui in connection with Sikandra P.S. Case No. 56 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
