JUSTICE ARUN KUMAR ORAL ORDER 27-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 21.12.2017 seeks bail in connection with Maniyari P.S.Case No. 279 of 2017 registered under Sections 376 and 511 of the Indian penal Code and 4 and 8 of POCSO Act.
Allegation in brief is that petitioner, after entering into the house of the informant, was making an attempt to commit rape to her daughter aged about 12 years, on alarm, he was apprehended by the villagers.
Submission is that it is not disclosed in the FIR that which of the villagers turned up there so it's a vital contradiction. It is also submitted that petitioner is the next door neighbour having some dispute but no specific nature of dispute is disclosed. Having considered the aforesaid facts and circumstances
Patna High Court Cr.Misc. No.17687 of 2018 (2) dt.27-03-2018 2/2 and specific accusation against the petitioner, the prayer of bail is presently rejected, however the petitioner may renew the prayer of bail after six months.
