JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-02-2018 Heard the learned counsel for the petitioner and the learned counsel for the State.

The petitioner seeks anticipatory bail in connection with Fenhara PS case no. 65 of 2015 dated 22.11.2015 registered for the offences punishable under Sections 386 and 387 of the Indian Penal Code.

The allegation is regarding the informant receiving a call on his mobile asking him to pay a sum of Rs. 5 lacs, failing which he would be eliminated. The said caller had disclosed his name as Manoj Singh belonging to one Azad Hind Fauz. During the course of investigation, the said Manoj Singh and Sahni Singh were arrested and they disclosed the name of the petitioner as one of their accomplice.

The learned counsel for the petitioner submits that the name

No.51148 of 2017 (4) dt.05-02-2018 2/2 of the petitioner had transpired during the course of disclosure made by the main accused persons and, in fact, there is no material on record to connect the petitioner with the alleged crime. Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of this order, the petitioner above named is directed to be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- XII, East Champaran, Motihari in connection with Fenhara PS case no. 65 of 2015, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
