JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 376 of the Indian Penal Code and Sections 4 and 5 of the Protection of Children from Sexual Offences Act.

The prosecution case is that 12 years old dumb daughter of the informant was ravished by the petitioner when she went outside to ease.

It is submitted by learned counsel for the petitioner that during medical examination, the age of the victim was found between 17 to 19 years and no sign of rape has been found. Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for

Patna High Court Cr.Misc. No.4507 of 2016 (2) dt.02-02-2016 2/2 regular bail of the petitioner if he surrenders within a period of six weeks in connection with Mahila (Patna) P.S. Case No. 35 of 2015 pending in the court of learned ADJ-I, Patna. Accordingly, the application is disposed of.
