Petitioner seeks regular bail in connection with Hussainganj P.S. Case No. 344 of 2021 registered under Section 392 of the I.P.C.

As per the First Information Report the informant was surrounded by three unknown miscreants riding on a motorcycle. They snatched the bag from the informant containing Rs. 2.75 lakh along with keys, Identity Card etc. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on the basis of his confessional statement recorded in another case and has been remanded from Hussainganj P.S. Case No. 26 of 2022. She further submits that no T.I.P. has been done by the Police up till now and the petitioner is in custody since

Patna High Court CR. MISC. No.51555 of 2022(2) dt.09-12-2022 2/2 03/02/2022. She next submits that no looted article and / or incriminating material has been recovered from the possession of the petitioner.

Regard being had to the submissions made by the parties, taking into consideration the fact that petitioner has not been put on T.I. Parade, he is in custody since 03.02.2022, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence if released on bail, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25000 /- ( twenty five thousand) with two sureties of the like amount each to the satisfaction of learned ACJM IXth, Siwan in connection with Hussainganj P.S. Case No. 344 / 2021 on the condition that the petitioner shall remain physically present on each and every date during the course of trial and in case of default on two consecutive dates, his bail bond shall liable to be cancelled.
