2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 419 and 420 of the Indian Penal Code and section 7 of the EC Act.

3. As per the prosecution case, petitioner who is PDS dealer has misappropriated 149.51 quintal rice and 60.02 quintal wheat which was supplied to him for distribution to PDS card holders.

4. Learned counsel appearing for the petitioner, while denying the allegation, submits that PDS card holders have never made any complaint against the petitioner. Moreover, his PDS licence has already been cancelled against which appeal is pending before the Commissioner. Petitioner claims clean

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Munger in Mufasil Police Station Case No. 67 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
