It would appear from perusal of the fardbeyan of the informant that it was co-accused Chhotu Das, who gave fatal blow to the deceased and so far as petitioner no. 1 is concerned, it is stated that he instigated the other accused whereas petitioner no. 2 assaulted the informant with fists and slaps. Considering the aforesaid facts and circumstances as well as role played by the petitioners in the alleged occurrence, let
