JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-03-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Sitamarhi Police Station Case No. 816 of 2015, disclosing offences under Sections 406, 419, 420, 467, 468, 471/34 of the Indian Penal Code.

A supplementary affidavit has been filed on behalf of the petitioner stating that out of inadvertence, it has been mentioned in paragraph 3 of the application that the petitioner has criminal antecedent. It has been stated that the petitioner has no criminal antecedent. He has also submitted that the case of the petitioner is on much better footing than that of Ashok Singh, who has been granted anticipatory bail by this Court, by order dated 19.02.2016,

Patna High Court Cr.Misc. No.4564 of 2016 (3) dt.04-03-2016 2/2 passed in Criminal Misc. No. 5029 of 2016 inasmuch as the allegation against the petitioner is that he merely identified the signatures of the vendee.

Considering the submission, as above, this application is allowed.

Let the petitioner, Ram Jai Prasad @ Ram Jap Rai, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi Police Station Case No. 816 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
