JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------- 03-02-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioners seek bail in connection with Piprahi P.S. Case No.50 of 2015 registered under Sections 341, 323 and 302/34 of the Indian Penal Code.
The accusation is that in course of quarrel between the parties, these petitioners caught hold of the hands of Pramod Upadhyay, the husband of the informant, and, thereafter, coaccused, Pawan Tiwari, the son of these petitioners, shot fire at the chest of Pramod Upadhyay, the husband of the informant, causing his death.
Patna High Court Cr.Misc. No.55332 of 2015 (3) dt.03-02-2016 2/2 Learned counsel appearing on behalf of the petitioners submits that the petitioners happen to be the parents of the coaccused, Pawan Tiwary, against whom there is allegation of making firing at the deceased and due to that reason, the petitioners have also been implicated in this case with the allegation of catching hold of the hands of the deceased, The petitioners having no criminal antecedents are in custody since 14.06.2015.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar, in connection with Piprahi P.S. Case No.50 of 2015.
