The petitioner seeks bail in connection with Khanpur P.S. Case no. 143 of 2017 registered under Sections 30(a), 38(1), 38(2), 41, 47 of the Bihar Excise and Prohibition Act 2016. 53 lts. of foreign liquor is said to have been recovered from the Alto car and its driver (petitioner) was apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. Petitioner happens to be driver of the said car and he was transporting the cartoon as per instruction of its owner being unaware of contents of the said cartoon. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl.
