The petitioner is aggrieved by the order of the Circle Officer, Phulwari Shariff, Patna passed in Mutation Case No.13168 of 2020-21 & 6154 of 2022-23 respectively, whereby and whereunder the petitioner's claim seeking mutation in their name in regard to the land purchased through sale deed Nos.8977 & 8023 dated 22.11.2020 & 30.05.2022 respectively,

Patna High Court CWJC No.11470 of 2024(2) dt.05-08-2024 2/3 situated in Village-Sakraicha, Thana No.75 having Khata No.38, Plot No.1939 area 3.125 dec., Khata No.38, Plot No.1943, area1 dec. & Khata No.105, Plot No.1944, area-2.125 dec. and registered sale-deed No.8023 dated 31.05.2022 situated in Village-Sakraicha, Thana No.75 bearing Khata No.105 & Khesra No.1944, area-3.125 dec. has been rejected on the ground of being a Gair Mazarua Malik land. The petitioners also seek quashing of the common appellate order dated 16.06.2023 passed by the respondent No.5 LRDC, Patna Sadar, Patna, passed in Mutation Appeal Cancellation No.99 of 2023-24 and 100 of 2023-2024 by which the order of the Circle Officer, Phulwari Shariff, Patna, in the aforenoted Mutation Case stands affirmed.

Learned Advocate for the petitioner contended that identically situated person namely, Kiran Devi, being aggrieved by the common order as noted hereinabove, approached before this Court in CWJC No.10423 of 2024, however, the same came to be disposed off vide order dated 18.07.2024 giving liberty to the petitioner to file a proper application as provided under Section 8 of the Bihar Land Mutation Act, 2011.

4. In view of the fair submissions made on behalf of the parties; this writ petition stands disposed off in terms of

Patna High Court CWJC No.11470 of 2024(2) dt.05-08-2024 3/3 order dated 18.07.2024 in CWJC No.10423 of 2024, with the similar liberty.
