The petitioner, who is in custody, seeks bail in connection with Naya Ram Nagar P.S. Case No. 194 of 2017 registered for the offence punishable under Section 302/34 of the Indian Penal Code and 27 of the Arms Act. Informant is the husband of deceased, who, in his fardbeyan has stated that on 14.09.2017 when he returned to his home his daughter informed that her wife deceased Bindu Devi had left the home at 1.30 PM but had not returned and thereafter he alongwith his son went to search her and he saw that 910 persons were standing on the concrete road and someone fired and 6 persons fled from there who were identified

Patna High Court Cr.Misc. No.6458 of 2018(3) dt.05-03-2018 2/2 by the informant which included petitioner Gujo Mandal. It has been submitted that there has been land dispute between the parties and there is no specific allegation against the petitioner of any overt act committed by him. It has further been submitted that similarly situated co-accused Saligram Mandal has been granted regular bail by a Coordinate Bench of this Hon'ble Court vide order dated 17.02.2018 passed in Criminal Miscellaneous No. 5130 of 2018. It has been further submitted that petitioner has no criminal antecedent and he is in custody since 15.09.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Munger, in connection with Naya Ramnagar P.S. Case No. 194 of 2017.
