2. The petitioner is an accused in connection with NDPS (Gr.) No. 44 of 2021 arising out of Hajipur Sadar P.S. Case No. 648 of 2021 registered for the offences under sections 20, 22, 23, 24, 27 and 29 of the N.D.P.S. Act lodged on 17.07.2021 by the informant, Dharmendra Kumar.

3. As per the prosecution story, when the police patrol party reached the village-Manua near the poultry farm of Suraj Patel, two persons tried to escape from that place leaving a motorcycle. They were apprehended who disclosed their names as Suraj Patel and Sanjay Kumar Paswan (the petitioner herein). The plastic bag that was hanging on the motorcyle was checked

Patna High Court CR. MISC. No.55345 of 2023(6) dt.10-04-2024 2/2 and the police states that 35.200 Kgs. of 'Ganja' was recovered from him.

4. In this case, reports were called for from the Trial Court and the last report vide letter no. 06 of 2024 dated 16.01.2024 would show that on that particular day, three out of four witnesses were already examined/cross-examined which included the Director, F.S.L., Bhagalpur, the Constable and a Sub-Inspector of Police and for the sole witness who was to be examined and summon/bailable warrant has been issued.

5. In that background, it would be appropriate that the petitioner face trial since it is at its fag end. It is expected that in any case, in four months, the trial will be concluded and an order be passed.
