The petitioner seeks bail in connection with Jhaja P.S. Case No. 105/2020 (G.R. No.- 958/2010) registered for the offence punishable under Sections 302/201/34 of the Indian Penal Code.
As per the prosecution case, informant's daughter was married with Onkar Sah in year 2008 and out of their wedlock they have been blessed with three children but since last three years her daughter was tortured by the accused persons for dowry. The further allegation is that accused persons
Patna High Court CR. MISC. No.49822 of 2022(2) dt.13-12-2022 2/2 killed informant's daughter and made her dead body disappeared. Her dead body was found at Gandoghat dam. Learned counsel for the petitioner submits that petitioner is father-in-law of the deceased who is living separately and co-accused husband of the deceased is in jail. The co-accused mother-in-law of the deceased has been granted bail vide order dated 02.11.2022 passed by the Co-ordinate Bench of this Court in Cr. Misc. No. 42423 of 2022. Petitioner is in jail custody since 06.04.2022 having no criminal antecedent.
Learned APP for the State has opposed the prayer for regular bail for the petitioner.
Considering the facts and circumstances of the case, let the petitioners above, named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M. Jamui in connection with Jhajha P.S. Case No. 105 of 2020.
