The petitioner, namely, Ram Niwash Chouhan @ Shambhu is in custody in Aurangabad(Town) P.S. Case No.332 of 2015 under Sections 399/402 of the Indian Penal Code and 25(1B)a/26/35 of the Arms Act. The learned counsel for the petitioner submitted that the allegation is that from the possession of this petitioner, one country made pistol loaded with one cartridge was recovered. The petitioner is in custody since 11.08.2015.

Considering the above facts and the nature of allegation, I direct the petitioner named above to be released on

Patna High Court Cr.Misc. No.55687 of 2015 (2) dt.16-12-2015 bail on furnishing bail bond of Rs.5,000/-(Rupees five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad(Town) P.S. Case No.332 of 2015.
