ANJANA MISHRA ORAL ORDER 05-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 22.09.2017 in connection with Barahiya P.S. Case No. 178/2017 registered for the offences punishable under Sections 364/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that only because the informant wanted to escape from payment of the fare of the Magic vehicle, the informant has named the petitioner as having attempted to kidnap the rickshaw puller along with his e-rickshaw. Learned counsel for the petitioner further submits that similarly situated Sonu Kumar Poddar who was also taken into custody on the same date i.e., 22.09.2017 has been granted bail by a Bench of this Court vide order dated 21.02.2018 passed in Cr. Misc. No. 2079 of 2018.

Diary in this case has been called for which has since been received, also corroborates the similar story.
