JUSTICE BIRENDRA KUMAR ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 365 and 385 of the Indian Penal Code.

According to FIR, the allegation against the petitioner is of kidnapping of the daughter of the informant. The victim-girl is physically present in Court and submits that she has voluntarily married with the petitioner and on similar ground co-accused have been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 31.01.2017 passed in Cr. Misc. No. 46767 of 2016.

Considering the statement of the victim, let the petitioner, above named, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.49801 of 2017 (2) dt.18-10-2017 2/2 before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Kahalgaon N.T.P.C. Police Station Case No. 21 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
