2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(a), 32(2)(3), 41(1)(2) of the Bihar Prohibition and Excise Act.

3. Total 443.52 litres of foreign liquor has been recovered from a field.

4. It is submitted that nothing has been recovered from conscious possession of this petitioner. Recovery has been made from open field which is accessible to general public. Name of petitioner transpired in this case only on suspicion. Petitioner has got no criminal antecedent of similar nature.

5. Considering the facts aforesaid, the petitioner

No.50304 of 2023(3) dt.18-08-2023 2/2 above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise-cum-Additional Sessions Judge-II, Nalanda in connection with Hilsa P.S.
