Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120(B),34 of the Indian Penal Code and 27 of Arms Act.

According to FIR, the informant's daughter was shot at while traveling on a tempo. Suspicion is against the FIR named accused persons. Petitioner is not named in the FIR.

Learned counsel for the petitioner submits that FIR named accused Rajesh Gupta @ Rajesh Kumar Gupta has already been allowed bail by a Coordinate Bench of this Court in Cr.Misc.No.1540 of 2018 and co-accusedSagar Raj, who is not named in the FIR, he is son of Rajesh Gupta @ Rajesh Kumar Gupta has also been allowed bail by

Patna High Court Cr.Misc. No.21980 of 2018 (2) dt.20-04-2018 a Coordinate Bench of this Court vide Annexure-3. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T.No.151 of 2018 (arising out of Industrial Area Police Station Case No.131 of 2017), subject to the condition that the petitioner shall fully cooperate with the investigation/ trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
