ANJANA MISHRA ORAL ORDER 05-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is in custody since 26.10.2015 in connection with Jagdishpur P.S. Case No. 259 of 2014 for the offences punishable under Sections - 302/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that though originally the case was lodged under Section 302, however, on enquiry, it was found that it was a case of suicide and accordingly a charge-sheet was submitted under Section 306. Learned counsel for the petitioner further submits that during the course of investigation and in the diary, it has come that the victim lady had committed suicide and the family members of the informant had
Patna High Court Cr.Misc. No.134 of 2016 (3) dt.05-02-2016 2/2 been duly given the information who had also participated in the cremation proceedings.
Considering the aforementioned facts that the prior information was sent to the infromatn's family at the time of death of the victim lady and admittedly there was no allegation of torture , let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri. Ashok Kumar Manjhi, learned Judicial Magistrate Ist Class, ARA in connection with Jagdishpur P.S. Case No. 259 of 2014.
