Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 379, 504, 34 of the IPC.

As per the prosecution case, petitioner no. 1 gave farsa blow on the head of Sunny Yadav which has been opined to be grievous in nature and so far as petitioner no. 2 is concerned, he is alleged to give iron rod blow on the head of Ranjeet Yadav and injury has been found to be simple in nature. Considering the grievous nature of injury, prayer for bail of petitioner no. 1 is refused with direction to the petitioner

Patna High Court CR. MISC. No.50208 of 2022(6) dt.13-03-2023 2/2 to surrender and seek regular bail, which would be disposed of on its own merit without being prejudiced by this order. Considering the injury to be simple in nature, in the event of arrest/surrender within six weeks from today, let the petitioner no. 2, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate at Motihari, District- East Champaran in connection with Mahila Harsiddhi P.S. Case No. 27/2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
