JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------ 13-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehends their arrest in connection with Narari Kala Khurd P.S. Case No.34 of 2017 registered under Sections 147, 448, 323, 341, 325, 308 and 506 of the Indian Penal Code.
The accusation is that 9 persons, named in the F.I.R., including the petitioners, on entering into the house of the informant caused fracture injury at the hand of the father of the informant through lathi and also caused injury at the finger of the
Patna High Court Cr.Misc. No.60588 of 2017 (2) dt.13-12-2017 2/2 left hand of his one daughter. They also caused fracture injury at the left hand of another daughter of the informant and also dashed his two years son causing fracture injury of his chest and gave threatening to the informant that if he would not execute the sale deed of the land, they would kill him.
Learned counsel for the petitioners submits that, in fact, due to land dispute, the scuffle in between the children and ladies of both sides, the occurrence of "Maar-Peet" took place in which four persons, named in the F.I.R., sustained injuries, which are of simple in nature.
Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad (Bihar), in connection with Narari Kala Khurd P.S. Case No.34 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
