Petitioner seeks bail in Sadar P.S. Case No.196 of 2019 instituted for the offence under Section(s) 457, 380 Indian Penal Code.
Counsel for the petitioner submits that Petitioner is in custody since 07.06.2019 having clean antecedents. In the written report, it is alleged that theft has been committed in the house of the informant by unknown persons. They took away rupees fifty thousand cash, mobile phones, etc. During investigation, one mobile phone is alleged to have been recovered from possession of the petitioner. Counsel for the petitioner submits that petitioner is
Patna High Court CR. MISC. No.47354 of 2019(2) dt.05-08-2019 2/2 fruit vendor on Thela. He had purchased said mobile from another Thela vendor, namely, Aslam of the same locality and started using his SIM. He had no knowledge that mobile is stolen one.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with Sadar P.S. Case No.196 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
