JUSTICE SUDHIR SINGH ORAL ORDER 18-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 149, 323, 324, 307, 353, 337, 338, 333, 153A, 295, 295A, 298 and 504 of the Indian Penal Code.
The prosecution case is that due to water logging a dispute arose and thereafter mar-pit took place between different communities and petitioners have been made accused. It is submitted on behalf of the petitioners that they have falsely been implicated in the present case. For the same occurrence four cases have been instituted. In other case, they have already been granted bail. No specific overt act has been alleged against petitioners in the present case. On behalf of the State, it is submitted that petitioners are named in the F.I.R.

No.5499 of 2016 (3) dt.18-03-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Yogapatti P.S. Case no. 359 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
