JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sirdalla P.S. Case No. 31 of 2017, registered under Sections 341, 323, 504 and 307 of the Indian Penal Code.

The accusation is that, in the evening of 14.02.2017, petitioner and Jitendra were scuffling with the villagers then informant reached there and tried to pacify the dispute. But at that time, both petitioners caused injury at the head of the informant through patkatti (sharp cutting weapon).

Learned counsel for the petitioner submits that, in fact, informant started quarrel with Ramdeo Rajbanshi, father of the petitioner, in which, father of the petitioner also sustained injury,

Patna High Court Cr.Misc. No.56438 of 2017 (2) dt.05-12-2017 regarding which, Sirdalla P.S. Case No.30 of 2017 is also instituted on the basis of written report of Ramdeo Rajbanshi, father of the petitioner. Moreover, two injuries as found on the person of the informant are simple in nature and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Nawada, in connection with Sirdalla P.S. Case No. 31 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
