JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2015 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The informant claims himself to be an eye witness of the alleged occurrence and specifically stated that the petitioner and one another FIR named accused person took his wife on a motorcycle. The occurrence took place on 03.06.2015 and the first information report was lodged on 04.06.2015. The victim has recovered and her statement was recorded under section 164 Cr.P.C on 06.06.2015 and in the aforesaid statement she did not name the petitioner, though petitioner appears to be the resident of parental house of the victim.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.54605 of 2015 (2) dt.08-12-2015 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. West Champaran at Bettiah in Shikarpur P.S. Case No. 233 of 2015.
