Petitioner seeks bail in Excise Case No.1083 of 2019 arising out of Udwant Nagar P.S. Case No.221 of 2019 instituted for the offence under Section(s) 30(a), 30(d) of Bihar Prohibition and Excise Act, 2016.

It has been submitted that illicit liquor and other articles have been recovered from the bank of river. There is no recovery from conscious possession of the petitioner. Petitioner has been made accused merely on suspicion.

Counsel for the petitioner submits that Petitioner is in custody since 18.06.2019 having clean antecedents. In the facts and circumstances of the case, prayer of

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 4th Additional Sessions Judge cum Special Judge, Excise Act, Bhojpur, Arrah, in connection with Excise Case No.1083 of 2019 arising out of Udwant Nagar P.S. Case No.221 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
